Inquiry from David de Isaac Leon, ward of Raphael ben Abraham Mendes da Costa: Two merchants A and B operated a business together in Sepphoris. They learned from friends that there was a severe famine on an island. A went there to verify that the prices of grain were particularly high there. Finding it to be true, he wrote to B asking him to immediately send 1,000 sacks of grain, but to insure the shipment. B did so. The ship sank, and after the insurer paid the claim, B bought another 1,000 sacks of grain and shipped them to A. When the shipment arrived, there was hardly any grain to sell on the island, resulting in a significant loss for the business. A refused to share in the loss. B had acted without specific instructions for the second purchase, and this behavior was contrary to the spirit of their partnership. In accordance with a decision by Rabbi Joseph Colon (Schoref 15), Moses ben David Rodriguez Lopez condemns B to bear the entire loss. [It should be noted that there was a considerable time between the first and second shipments.]
