Hirsch Summary
A entrusted B with a consignment of goods to sell at another location. There, B was to invest half of the proceeds in specified other goods and send them back. However, since B considered one type of goods more profitable, he only bought from that and sent everything back as agreed. On the way, the transport was attacked by robbers and lost. A now claimed against B because he had invested all the money in one type of goods, thus changing his mandate on his own initiative. David ben Raphael Meldola decides in favor of B, as there is no connection between B's autonomous actions and the robbery. See also 52, 301, 443, 706.
