Hirsch Summary
Two merchants, A and B, who jointly operated a store, dissolved their partnership. They agreed that A would keep the store with its assets, but also the debts, and would pay B his share after one month. B immediately informed the creditors of the agreement, to which they declared that A and B remained jointly liable for the old debts. That night, the store with its assets burned down. A now argued that the creditors' declaration had invalidated the entire agreement, and B should bear the burden of the fire damage. B demanded that the declaration did not affect their internal arrangement and requested his payment on the due date. Chija Cohen de Lara sides with B.
