Hirsch Summary
A rented a house to B for 200 gulden annually. C provided surety for B for one year. After a year and three months, A called upon C to fulfill the surety, but C refused payment. C argued that A should have approached him at the end of the year, but now he had returned the collateral to B and was no longer responsible. Juda Piza ruled that C must pay, but A needed to swear that he had not received anything yet.
