Hirsch Summary
Among the papers of the deceased A, the guardian of his orphans found a promissory note for 1100 guilders in the name of B. B declared at maturity that 100 guilders of it were interest, which he did not want to pay, as it violated the commandment of the Torah. He had taken the loan from A in great need, as otherwise he would have had to pay a markup on his purchases, which would have amounted to 20 percent annually. Isaac Saruco sentenced B to pay the entire 1100 guilders, as he could not prove that the 100 guilders were interest.
