A and B had jointly purchased captured goods at an auction. One condition of the auction was that the goods had to be taken as they were, without the buyer having the right to object. A and B sold a part for joint account, divided another part based on the number of sacks, and another part based on weight. They only retained joint ownership for items that were difficult to divide, such as precious stones. Some of A's items were damaged. A wanted compensation from B, who, favored by chance, had a particularly valuable piece among his items. B wanted to compensate for the damage but exclude the valuable piece from it. Chija Cohen de Lara ruled that B must fully compensate.
