            <text>Inquiry from Jacob ben Salomo Chiskijahu Saruco: An Amsterdam merchant left on a ship on the 23rd of Sivan 5505 in Amsterdam. When the ship was in danger of grounding, he went ashore and was not seen again. Four years later, a Jew came to Amsterdam and testified before the court that a non-Jew had followed the people who had left the ship and found three dead Jews on the shore. One of them was the Amsterdam merchant. Before the Beth-Din gave the woman formal permission to remarry, she married without this permission. Then another Jew came to court and testified that he had seen a fellow believer in chains in a city, who begged earnestly to be freed from his oppressors. When asked who he was, he gave the name of the merchant and said he had a wife and children in Amsterdam and had left on the 23rd of Sivan 5505. The court heard from the new husband of the woman to clarify the situation. It turned out that the new husband had entered into the marriage without permission. He had even unsuccessfully sought permission from a Torah scholar. The inquiry closely resembles one directed to Rabbi Samuel de Medina (Eben haezer No. 59). Isaac ben Jacob Henriquez Faro examines the question and finds support for his opinion, which is to allow the woman to remain with her new husband, in the responses of Rabbi Joseph ben Leb (8th question). However, in accordance with the contrary decision of Rabbi Samuel de Modena (Eben haezer No. 59), he acknowledges that this is a disputed matter among significant legal scholars and defers the decision to the rector.
