However, the friend shipped almonds, raisins, etc., as he deemed it a better deal. The arrival of the ship was delayed, and the buyer feared he might incur a loss. Seeing his end near, he vowed on his deathbed to donate 10% of his cargo to the Torah scholars of the city if the ship arrived safely. After his death, the ship arrived after a five-month sea voyage, but the cargo was heavily damaged by seawater. The heir refused to fulfill the vow and also wanted to hold the shipper accountable. The shipper argued that if he had acted as instructed, the recipient would have lost everything. For by the time Passover had passed, the entire shipment would have been forbidden as leavened. Moses ben Samuel Israel decides that the son is not bound by the vow, and the shipper is not obliged to pay compensation.
