However, the husband was only willing to pay 5,000 florins. Moses ben David Rodrigues Lopes ruled that in the first case, the wife's statement was not considered binding. In the second case, he ruled against her claim as well.</text>

When the father fell seriously ill and was expected to die soon, the son, knowing that the father would never be able to ride again, accepted the horse as a gift. Then the son sold the horse at a high price to a friend. However, three years later, the father recovered and wanted to ride the horse again. He learned that it had been sold and wanted to undo the sale. He said that he had only granted permission to his son to have the use of the horse in order to have peace. However, he had only allowed him to use it, not to sell it. Also, due to his illness, he could not have intervened earlier, so the current owner did not acquire ownership even through prescription. David ben Abraham Franco Mendes decides that the gift of the horse, not having been done in the legally prescribed form for living animals, is null and void. The owner must return the horse to the rightful owner along with the equipment with which he received it, and he must also pay a reasonable rent. He can only reclaim the purchase price from the son, not from the father.</text>

An agreement was reached that the debtor would surrender all inventory and provide a list of his outstanding debts, so that they could be collected from the creditors. In this agreement, the creditors lost 10,000 guilders. A demand for 10,000 guilders was omitted from the list because the debtor, a non-Jew, had also fallen into financial difficulties and emigrated to India. When this non-Jew, who had since become wealthy again, died three years later, his creditors inherited his entire estate according to his will. A received 40,000 guilders from this. When A's creditors learned of this, they claimed that A had deceived them in the agreement. Therefore, the agreement was invalid. They demanded the 10,000 - rightfully theirs - and also the entire 40,000 guilders. Jacob ben David Fidanque declares the claim for the 10,000 guilders to be justified, but the additional demand is to be rejected as unauthorized and violates the biblical prohibition of usury.</text>

              <text>A man in Kefar Ako vowed to sell a pack of gemstones (?????? ????????) , which he believed were worth 20,000 gulden, half for the bride's dowry and half for the ransom of captives. His friend, to whom he entrusted the sale, found that the stones were likely worth no more than 15,000 fl. A merchant, however, was willing to pay 20,000 fl. for them, but only if he was granted a loan of 6,000 fl. for a year. The intermediary did not agree to this. He finally offered 18,000 fl. He then proposed to his friend, who was about to marry a wife, to give him 8,000 fl., thereby freeing himself from one part of his vow and retaining 10,000 fl. for the other part. The friend, however, did not want that and held him liable for the shortfall. Moses ben Samuel Izrael decided that the intermediary was not liable. He acted correctly in not selling on credit without a specific order. The other, however, is free from his vow, regardless of whether he gives the 8,000 fl. to the bride or someone else.</text>

A demanded the wool from C, which C confirmed. Before the flax arrived, the price of wool went down, and flax became more valuable. Since the consignments (poliza di cargo) were in the name of A, he now wanted to keep the flax and not accept the wool, which had not yet been weighed for him. Moses ben David Rodrigues Lopes decides that A has no right to the flax but may also reject the wool; he would then have a monetary claim against B.</text>

              <text>A widow had sold and given away items from her deceased husband's estate. She died without having sworn her ketubah (marriage contract). The heirs of the woman demanded payment of the ketubah from the heirs of the man. Although the ketubah document was no longer available, its amount was certain. The heirs refused to pay the ketubah and demanded the gifts made by the widow from the recipients. Joseph Piza decides: the heirs of the man are not obligated to pay the ketubah and even have a claim to the gifts made from it. However, the heirs of the woman have a claim to the dowry, as well as the recipients for the gifts made from the dowry.</text>
